Member Legal Services has published a revised legal article, Commissions (September 22, 2008). It is available on Legal's What's New and the Legal Articles pages on C.A.R. Online. There have been several substantive changes from the 2004 version. First, the list of applicable forms was updated in Question 2. Second, Question 18 was added to address commission issues in short sale transactions. Third, several links as well as legal citations were added where appropriate. Finally, Question 5 was expanded to include mention of all the provisions that may be required in a commission agreement and when applicable.

The article was reviewed for accuracy. Question 9 was modified to clarify that individuals may not request a legal opinion from the California Attorney General’s Office only certain government officials may do so.

Question 21 was revised to clarify the issues of RESPA, referral fee prohibition, and giving a “small token of appreciation.”
